EEC/122 13/09/06 13/10/06 Electrical and electric equipment European Communities: Directive 2002/95/EC introduces an obligation for member States to ensure that from 1 July 2006, new electrical and electronic equipment put on the market does not contain lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE). However, its Annex foresees a series of exemptions. HKG/27 24/08/06 19/09/06 Chilled beef, mutton or pork Hong Kong, China:  The Amendment Regulation requires chilled beef, mutton or pork to be pre-packaged and properly labelled if it is sold in fresh provision shops/market stalls which also sell fresh beef, mutton or pork.  Information required to be shown on the labels is similar to the existing labelling requirement for pre-packaged food in general under the Food and Drugs (Composition and Labelling) Regulations (Cap. 132 sub. leg. W), e.g. name, "use by" date, net weight, etc.  In addition to that, the labels are required to indicate the name and address of the slaughtering plant and the slaughtering date.  Where pre-packaging and labelling are required under the Amendment Regulation, such procedures may be completed either in the exporting country or in Hong Kong, China. The main novelty with the proposal is the new rules concerning buildings.  Buildings constructed or renovated during the years 1956–1973 may still contain materials with elevated levels of PCB.  Therefore owners of buildings built or renovated during the years 1956–1973 has to make an inventory concerning the existence of PCB-product and remove those products with PCB content exceeding 0,050 % by weight. The labelling of this additional information is required to be labelled on the body of products in the form of sewing tags or hang-on tags or labelled on the inner or outer wrappers. FDA is issuing this proposed rule after considering new data and information on the safety of hydroquinone, the only active ingredient that had been proposed for inclusion in a monograph for these products.  This proposal is part of FDA's ongoing review of OTC drug products.  Further, upon issuance of a final rule, FDA intends to consider all skin bleaching drug products, whether currently marketed on a prescription or OTC basis, to be new drugs requiring an approved new drug application (NDA) for continued marketing. CAN/146 10/11/05   04/01/06 Vehicles emission " Canada - The proposed Regulations Amending the On-Road Vehicle and Engine Emission Regulations (hereinafter referred to as the ""proposed amendments"") have the primary purpose of introducing new requirements for 2006 and later model year on-road motorcycles to maintain alignment with new rules of the United States Environmental Protection Agency (EPA). The On-Road Vehicle and Engine Emission Regulations (G/TBT/N/CAN/32) (hereinafter referred to as ""the current Regulations"") under the Canadian Environmental Protection Act, 1999 (CEPA 1999) came into effect on 1 January 2004. The current Regulations contain standards for smog-forming emissions for various classes of on-road vehicles and engines, including requirements for motorcycles of the 2004 and later model years. The current Regulations were designed to align Canadian requirements with corresponding federal emission standards of the EPA. The proposed amendments continue the approach of aligning with the federal emission standards of the EPA. The combustion of fuels to power vehicles and engines contributes significantly to air pollution, which has major adverse impacts on the environment and on the health of Canadians. The proposed amendments will ensure that Canadian emission standards for on-road motorcycles remain aligned with more stringent standards adopted by the EPA. Accordingly, the proposed amendments would contribute to further reducing emissions of hydrocarbons (HCs), oxides of nitrogen (NOx) and certain air pollutants that have been listed as ""toxic substances"" in Schedule 1 to CEPA 1999 (e.g. benzene, 1,3-butadiene, formaldehyde, acetaldehyde and acrolein), and will thereby contribute to the protection of the environment and health of Canadians. The amendment is: The distinction between products directly derived from GMOs (i.e. 1st generation products; e.g. corn starch) and products obtained by chemical modification of a 1st generation product (i.e. 2nd generation products; e.g. glucose/fructose syrup from corn starch) is no longer made. According to the Ordinance on the Approval Procedure for GMO foodstuffs, GMO Additives and GMO Processing Aids which preceded the above mentioned ordinance and which was valid until 31 December 2005, only 1st generation products were subject to compulsory authorization before marketing.

The Swiss population has adopted in a public voting in November 2005 a five year moratorium on the cultivation of GMOs in Switzerland. The main implication of the moratorium on the notified Ordinance is that no authorization of cultivation of GMOs can be granted before the end of the moratorium in November 2010. Pathogenic organisms: Requirements underwent minor changes. Invasive alien organisms: New requirements for notification of arthropodes and nematodes to be released into the environment for research and/or biocontrol. They include bans of the environmental use of certain alien organisms impairing biological diversity, endangering environmental, human and/or animal health or causing economical damage. USA/159 14/12/05   25/01/06 Motor Vehicle United States : On 29 September 2004, Assembly Bill 1009 (AB1009) was signed into law, amending Health and Safety Code Section 43701. The amendments require ARB to develop and implement, in consultation with the California Highway Patrol, regulations to ensure that heavy-duty commercial vehicles (HDCVs) operating in California are equipped with engines that, at the time of manufacture, met standards that were at least as stringent as emission standards promulgated by the United States Environmental Protection Agency (U. S. EPA). In adopting AB 1009, the Legislature found that heavy-duty vehicles equipped with engines emitting greater levels of oxides of nitrogen (NOx) and particulate matter (PM) than those designed to meet standards adopted by the U. S. EPA contribute to higher levels of ozone and PM, and pose a threat to public health in California. ARB staff’s proposal is designed to meet the requirements of the legislation. In developing its proposal, ARB staff met with stakeholders from companies that operate HDCVs in California, representatives from manufacturer-authorized HDCV service providers, representatives from the California Highway Patrol, and other interested parties at public workshops held on 16 May 2005, and 17 June 2005. FRA proposes miscellaneous amendments to its existing regulations in five areas by: Clarifying the terminology related to piston travel indicators; providing alternative design and additional inspection criteria for new passenger equipment not designed to allow inspection of the application and release of the brakes from outside the equipment; permitting some latitude in the use of passenger equipment with redundant air compressors when a limited number of the compressors become inoperative; recognizing current locomotive manufacturing techniques by permitting an alternative pneumatic pressure test for main reservoirs; and adding provisions to ensure the proper securement of unattended equipment.
FRA is also clarifying the existing regulatory requirements related to the attachment of safety appliances and is proposing an identification and inspection protocol to address passenger equipment containing welded safety appliances or welded safety appliance brackets or supports.

Based on experience gained since the promulgation of these regulations, EPA proposed these modifications along with various others in a Notice of Proposed Rulemaking (NPRM) published on 11 July 1997. In final rules published on 31 December 1997 and 28 December 2001, EPA took final action on several of the modifications proposed in the 11 July 1997 NPRM. Today's action proposes to take action on many of the remaining modifications in the 1997 NPRM. The modifications in today's proposed rule would correct technical errors, clarify certain provisions, and codify guidance previously issued by the Agency. USA/164 19/12/05   14/04/06 Air Brake Systems United States : The agency is proposing to amend our air brake standard to improve the stopping distance performance of truck tractors. Based on current safety trend data and brake system technologies for truck tractors, we are proposing to reduce the required stopping distance for these vehicles by 20 to 30 per cent. We have tentatively concluded that truck tractors are capable of achieving a reduction in stopping distance within this range with existing technologies. We also discuss research and request comment concerning improving the braking performance of other types of heavy vehicles, i.e., trailers, straight trucks, and buses. Based on the totality of publicly available scientific evidence, FDA has determined that blood cholesterol-lowering effects of oats and barley are equivalent. Therefore, FDA has concluded that consuming beta-glucan-containing whole grain barley or certain dry milled barley products may help reduce blood cholesterol levels, and FDA is amending 21 CFR 101.81 to include whole grain barley and certain dry milled barley products as substances eligible for the soluble dietary fiber- heart disease risk health claim. The Colorado Potato Administrative Committee, Area No. 2 (Committee), the agency responsible for local administration of the marketing order, recommended this rule as a replacement for a previously issued proposed rule. This rule would change the minimum grade from U.S. No. 1 to U.S. Commercial for varieties of long, red-skinned, yellow fleshed potatoes produced in Area No. 2 measuring from 1\1/2\ inch minimum diameter to 2\1/4\-inch maximum diameter (size B), and from 1-inch minimum diameter to 1\3/4\-inch maximum diameter. Some of the fruits and vegetables are already eligible for importation under permit, but are not specifically listed in the regulations. All of the fruits and vegetables, as a condition of entry, would be inspected and subject to treatment at the port of first arrival as may be required by an inspector. In addition, some of the fruits and vegetables would be required to meet other special conditions. In one case, we propose to add a systems approach that would provide an alternative to methyl bromide fumigation. These actions would provide the United States with additional types and sources of fruits and vegetables while continuing to protect against the introduction of quarantine pests through imported fruits and vegetables. EPA canceled food use registrations or deleted food uses from registrations following requests for voluntary cancellation or use deletion by the registrants, or non-payment of registration maintenance fees. Also, stakeholders have withdrawn their support for import tolerances for captafol and hexaconazole. EPA expects to determine whether any individuals or groups want to support these tolerances. The regulatory actions proposed in this document contribute toward the Agency's tolerance reassessment requirements under the Federal Food, Drug, and Cosmetic Act (FFDCA) section 408(q), as amended by the Food Quality Protection Act (FQPA) of 1996. By law, EPA is required by August 2006 to reassess the tolerances that were in existence on 2 August 1996. Benzene is a known human carcinogen, and mobile sources are responsible for the majority of benzene emissions. The other mobile source air toxics are known or suspected to cause cancer or other serious health effects. We are proposing to limit the benzene content of gasoline to an annual average of 0.62% by volume, beginning in 2011. We are also proposing to limit exhaust emissions of hydrocarbons from passenger vehicles when they are operated at cold temperatures. This standard would be phased in from 2010 to 2015. USA/212 30/08/06   07/11/06 Portable generators United States: In this document the Consumer Product Safety Commission (Commission or CPSC) proposes to require manufacturers to label portable generators with performance and technical data related to performance and safety.  The warning label would inform purchasers that:  "Using a generator indoors will kill you in minutes;'' "Exhaust contains carbon monoxide, a poison gas you cannot see or smell;''  "Never use in the home or in partly enclosed areas such as garages;'' "Only use outdoors and far from open windows, doors, and vents.''  The warning label will also include pictograms. USA/214 04/09/06   27/11/06 Human and animal drugs  United States: The Food and Drug Administration (FDA) is proposing to amend its regulations governing drug establishment registration and drug listing.  The proposed revisions would reorganize, consolidate, clarify, and modify current regulations concerning who must register establishments and list human drugs, human drugs that are also biological products (including vaccines and allergenic products), and/or human cells, tissues, and cellular and tissue-based products (HCT/Ps), and animal drugs.  The proposal describes when and how to register and list and what information must be submitted for registration and listing.  In addition, the proposal would make certain changes to the National Drug Code (NDC) system and would require the appropriate NDC number to appear on the labels for drugs subject to the listing requirements.  The proposed regulations generally would require the electronic submission of all registration and most listing information.  We (FDA) rely on establishment registration and drug listing information for administering many of our programs, such as postmarketing surveillance (including FDA inspections), bioterrorism, drug shortages and availability, and user fee assessments.  We are taking this action to use the latest technology to improve our registration and listing system, which would further our goal of protecting the public health.  We also believe that the conversion to an electronic system would make the registration and listing processes more efficient and effective for industry and us.  We are also taking this action to support the implementation of, for example, the electronic prescribing provisions of the Medicare Prescription Drug, Improvement, and Modernization Act, our rulemaking requiring a bar code on certain drug products, and the DailyMed initiative. USA/215 12/09/06   31/10/06 Motor vehicles United States: This document proposes amendments to certain provisions of the early warning reporting rule published pursuant to the Transportation Recall Enhancement, Accountability, and Documentation (TREAD) Act.  This document proposes to modify and clarify some of the manufacturers' reporting requirements under the rule.  It would identify a subclass of field reports referred to as product evaluation reports and eliminate the requirement that manufacturers submit copies of them to the agency, revise the definition of fire, modify reporting relating to fuel systems on medium-heavy vehicles and buses, and limit the time period for required updates to a few data elements in reports of deaths and injuries. OSHA, other Federal agencies, and stakeholder representatives have participated in long-term international negotiations to develop a Globally Harmonized System of Classification and Labeling of Chemicals (GHS). The GHS has been adopted by the United Nations, and there is an international goal for as many countries as possible to implement the GHS by 2008. The GHS includes harmonized provisions for classification of chemicals for their health, physical, and environmental effects, as well as for labels on containers and safety data sheets (SDS).
